Today, the U.S. Supreme Court delivered a significant win for the future of the E-Rate program by upholding the constitutionality of the Universal Service Fund, the financial backbone that supports broadband access for schools and libraries across the country.
In FCC v. Consumers’ Research, the Court reaffirmed that the longstanding arrangement between Congress, the FCC, and the Universal Service Administrative Company (USAC) is lawful, stating:
“Nothing in those arrangements, either separately or together, violates the Constitution.”
This decision ensures continued support for equitable access to technology and learning, particularly in rural and underserved communities.
This outcome is the result of strong advocacy from organizations like the Schools, Health & Libraries Broadband (SHLB) Coalition, which fought tirelessly to defend universal service.
